On Wednesday in Sioux County District Court, 26-year old Jose Vargas-Vargas was found guilty of Identity Theft, a class D felony.
The charges stem from a case on March 13, 2012, when a Colorado man contacted the Sioux County Sheriff's Office to report that someone was using his Social Security number and working at Nyhof Dairy in Sioux County.

As a result of the investigation by the Sioux County Sheriff's Office, Vargas-Vargas was charged with identity theft for using another person's Social Security number to fraudulently obtain employment at Nyhof Dairy. Vargas-Vargas is a native of Mexico who is not legally authorized to be employed in the United States. After an arrest warrant was issued, Vargas-Vargas was arrested in Council Bluffs, Iowa, on August 14, Vargas-Vargas pleaded not guilty.
Sentencing is set for December 17th. The maximum penalty for identity theft is an indeterminate prison term not to exceed five years and a fine not to exceed $7,500.
