Online court records show that 21-year-old Cody Millard entered a not guilty plea late last week and has a jury trial scheduled for February 26th in Clay County District Court. Pretrial is set for February 11th.
Millard and 21-year-old Christopher Fitzpatrick each face a class A felony count of 1st degree murder after 57-year-old Edward Kitto of Spencer was found badly beaten in the backyard of a Spencer home on August 27th. Kitto passed away at a Sioux Falls Hospital two weeks later.
Fitzpatrick also faces class B felony charge of 1st degree robbery and a class C felony count of willful injury causing serious injury. His trial is scheduled for December 11th with a pretrial on the docket for November 6th.
Sibley, IA (KICD)--Drug charges are levied against a Sibley man.
On Friday 50-year-old Robert McKean was arrested on two valid Osceola County Warrants for Possession of a Controlled Substance and Driving While Barred Habitual Offender. During the arrest, an Osceola County Deputy located drug paraphernalia in his coat pocket. As a result McKean was also charged with allegedly having Possession of Drug Paraphernalia and Possession of a Controlled Substance 3rd or Subsequent Offense.
McKean was held in the Osceola County Jail on a $3,500 cash bond.
