Orange City, IA (KICD)--A former Rock Valley man is sentenced on class C felony counts of Lascivious Acts with a Child and Sexual Exploitation of a Minor.

Sioux County Attorney Coleman J. McAllister tells KICD News that this case arose on March 13th when a Sioux Center woman came to the Sioux Center Police Department to report that they had discovered photographs of their 8-year-old son on the phone of 50-year-old Rogelio Zarate-Rios.  The family discovered the cell phone photos after he had been in a car accident using their vehicle and they went to retrieve their vehicle and discovered the cell phone which were indecent.

The woman told the police that Zarate-Rios had resided with the family for approximately four months during which time he had shared a bedroom with the child.

Zarate-Rios was sentenced to ten years in prison on each charge Monday in Sioux County District Court, with the sentences to run concurrently, for a total indeterminate prison term not to exceed ten years.  While he is a permanent legal resident, due to the felony convictions U.S. Immigration and Customs Enforcement plans to begin deportation proceedings for Zarate-Rios upon expiration of his prison term.
