Orange City, IA (KICD) — An Orange City woman accused of murder looks to have statements excluded from her trial.
The attorney for 34-year old Rochelle Sapp filed a motion to Suppress Monday, saying that Sapp wasnt read her Miranda rights, and that her statements werent given voluntarily, freely or intelligently..
Sapp is charged in Sioux County District Court with first-degree murder and child endangerment for the death of 3-year-old Autumn Elgersma last fall. Sapp is accused of fatally injuring Autumn while watching the child on Oct. 29th. Autumn died two days later at a Sioux Falls hospital from what police say were blunt-force head injuries.
Sapp first told investigators Autumn fell down the stairs, but later admitted she had picked up the girl and thrown her down against the ground because she didn’t ask for help taking off her jacket.
Sapp’s trial is set for November 13th in Carroll.
