Hospers Man Prison Time

Orange City, IA (KICD) — A Hospers man gets prison time, in Sioux County Court.
  Sioux County Attorney Coleman McAllister announced that 33-year old Gary Moore, was found guilty on March 5th,  by a Sioux County jury of the crime of Operating While Intoxicated – Third or Subsequent Offense, a Class D Felony, while being an habitual offender. Assistant Sioux County Attorney Andrea Glasgow prosecuted the case on behalf of the State of Iowa.

This case arose on December 1, 2012, when a Sioux County Deputy attempted to stop a vehicle driven in Hospers.  The driver, Gary Moore stopped the vehicle and entered a residence before the deputy could conduct the traffic stop. Moore was arrested and charged with Operating While Intoxicated – Third or Subsequent Offense after he tested .174 on an alcohol breath test at the Sioux County Sheriff’s Office.

Moore pleaded not guilty to the charge, claiming he was not driving the vehicle, and the case went to court March 4th and 5th.  The jury found Moore guilty after hearing evidence, and the Judge sentenced him to 15 years in prison, and he   must serve a mandatory minimum of three years before he is eligible for parole.
