Fort Dodge, IA (KICD) — A Fort Dodge man charged in an accident that killed two people enters a plea.
According to court records, 21-year old Austin Brown pleaded guilty to 2 class C felony counts of Vehicular Homicide by Reckless Conduct, shortly before noon on December 10th in District Court. The accident occurred December 21st of 2012, as Brown was driving his 2002 GMC pickup on Nelson Avenue, just south of John F. Kennedy Memorial Park.
His pickup crashed head-on into a 2002 Ford station wagon, driven by 23-year old Joseph Reigelsberger, of Rolfe. Reigelsberger and one of his passengers, 57-year old Debra Lundt, of Pocahontas, were pronounced dead at the scene.
At the hearing, Brown told Chief Judge Kurt Wilke, of the 2nd Judicial District, that he was texting before the accident, and then crossed the center line. Brown also said he had three illicit drugs in his system, at the time of the accident. After admitting those two issues, along with the bad weather were the cause of the accident, the Judge accepted the guilty plea on the charges.
The pleas are part of an agreement with prosecutors. Brown was originally charged with two counts of vehicular homicide by OWI. Sentencing is set for January 21st, 2014. Brown is facing up to 10 years in prison.
